1. Purpose

These terms set out the rules for using the Espir mobile app and the conditions of the subscriptions offered within it.

By installing and using Espir, you accept these terms. If you disagree with any of them, simply do not use the app.

2. Who publishes Espir

3. What Espir is, and what it is not

Espir is a mindfulness app for mealtimes. It offers a simple gesture, repeated before each bite, designed to slow the pace of a meal and bring your attention back to the present moment.

Espir is not a medical device. It makes no diagnosis, delivers no treatment, gives no nutritional recommendation, and is in no way a substitute for the advice of a doctor, dietitian, psychologist, or any other healthcare professional.

Espir is not a weight-loss programme, a calorie counter, or a weight-tracking tool. It pursues no weight-loss objective and collects no data of that kind.

If you are struggling with your relationship to food, in particular with an eating disorder, this app is not a replacement for professional support. We encourage you to speak to a healthcare professional.

Using Espir is your decision alone and your responsibility alone.

4. Access to the app

4.1 Account

An account is created automatically the first time you open the app, with no sign-up. You can then link it to an identity (Apple, Google, or an email address) so as to recover your data if you change devices.

Until the account is linked, your data stays tied to that device. If you uninstall the app without having linked your account, the data cannot be recovered.

4.2 Your credentials

You are responsible for keeping your sign-in credentials confidential, and for activity carried out from your account.

4.3 Age

The app may be used from the age of 15. Below that age, use requires the agreement of a parent or legal guardian.

4.4 Device and connection

Espir is distributed on Apple's App Store and on Google Play. Using it requires a compatible device and, for some features, an internet connection. Network access costs remain yours.

5. Subscriptions

5.1 What is free, and what is not

Downloading the app is free.

Access to the mindful meal experience and its associated features requires an active Espir subscription, or a free trial in progress.

5.2 The plans

The prices shown are those applicable in France, inclusive of all taxes. In other countries, the price shown at the time of purchase is the one set by the relevant app store (Apple's App Store or Google Play) according to its local pricing tiers, in the corresponding currency. The price that governs is always the one displayed in the app at the moment you subscribe.

5.3 Free trial

Each plan includes a 7-day free trial, available to new subscribers only.

One trial period is granted per Apple account or per Google account, whichever plan is chosen.

At the end of the 7 days, the subscription starts automatically and the first payment is taken, unless you have cancelled beforehand.

5.4 Subscribing and payment

Subscriptions are purchased exclusively through the in-app purchase system of the store you downloaded the app from: Apple's in-app purchase on iPhone, Google Play Billing on Android.

Payment is charged to the Apple account or the Google account linked to your device, at the moment you confirm the purchase.

A subscription purchased on one platform is not transferable to the other. If you move from iPhone to Android or the other way round, you will need to cancel on one side and subscribe on the other.

We have no access to your payment card details at any point.

5.5 Automatic renewal

Subscriptions renew automatically. Renewal is charged within the 24 hours preceding the end of the current period, for a further period of the same length, at the rate then in force.

5.6 How to cancel

You can cancel at any time, without giving a reason and at no cost.

Cancellation is done only from the settings of the store you subscribed through, not from within the app.

To avoid being charged, cancellation must take place at least 24 hours before the end of the current period, or before the end of the free trial.

After cancelling, you keep access until the end of the period already paid for. No pro-rata refund is issued for the remaining time.

Deleting the app or your Espir account does not cancel your subscription. Only the procedure above stops the renewal.

5.7 Refunds

If you subscribed on iPhone, refund requests are handled exclusively by Apple, as the seller of the subscriptions. We are technically unable to issue a refund. Requests are made at reportaproblem.apple.com or from your Apple account's purchase history. Apple applies its own conditions and decides the outcome alone.

If you subscribed on Android, requests are made from your Google Play account. Google handles requests submitted within 48 hours of purchase directly. Beyond that window, Google forwards the request to us and we review it case by case. Write to us at contact@espir.io, stating the purchase date and the email address of the account concerned.

In all cases, these procedures are without prejudice to the statutory guarantees available to you as a consumer.

5.8 Price changes

Prices may change. Any increase affecting an ongoing subscription will be notified to you by Apple or by Google before it takes effect, and will give you the opportunity to decline by cancelling. An increase never applies retroactively to a period already paid for.

5.9 Restoring purchases

If you change device or reinstall the app, you can recover your subscription using the Restore Purchases function on the subscription screen, provided you use the same Apple account or the same Google account as when you subscribed.

6. Right of withdrawal

Under Article L. 221-28 of the French Consumer Code, you expressly waive your fourteen-day right of withdrawal, given that access to the digital content is provided immediately upon subscribing — something you acknowledge and accept at the point of purchase.

In practice, the 7-day free trial lets you evaluate the app with no commitment before any payment is taken.

This waiver does not affect the statutory guarantees available to you, nor your ability to request a refund from Apple or Google under their own terms.

7. How to use the app

You agree to use Espir in good faith, and in particular not to:

  • circumvent, disable, or attempt to circumvent the access limits tied to the subscription
  • decompile, disassemble, or reverse-engineer the app, save within the limits permitted by law
  • extract the app's content by automated means
  • disrupt the service or attempt to access data that is not yours
  • use the app for unlawful purposes

8. Intellectual property

The Espir app, its name, visual identity, text, illustrations, animations, and all of its content are protected by intellectual property law and remain our exclusive property or that of our licensors.

Your subscription grants you a personal, non-exclusive, non-transferable right of use of the app. It transfers no ownership to you.

The content in the Discover section is made available for your personal reading. Any reproduction, distribution, or commercial exploitation, in whole or in part, is prohibited without our written agreement.

Content you create — meal names, personal notes — remains yours. We claim no rights over it and make no use of it.

9. Service availability

We do everything we can to keep the app accessible and working, without being able to guarantee uninterrupted availability.

The service may be temporarily suspended for maintenance, updates, or because of a failure at one of the technical providers we depend on.

The app evolves. Features may be added, changed, or removed. If a change were to substantially reduce what your subscription gives you access to, you would be informed and free to cancel.

10. Liability

Espir is provided as it stands, as a tool for support and mindfulness.

We cannot be held liable for:

  • the consequences of your food choices or personal decisions, the app issuing no prescription of any kind
  • a service interruption attributable to your device, your carrier, Apple, Google, or a third-party technical provider
  • data loss following uninstallation of the app while your account was not linked to an identity

Nothing in these terms excludes our liability in cases of gross negligence, wilful misconduct, or personal injury, nor the mandatory statutory guarantees available to you as a consumer.

11. Ending the agreement

On your side. You can stop using the app at any time, cancel your subscription as set out in section 5.6, and delete your account from the bottom of the Profile page.

On ours. We may suspend or delete an account in the event of a clear breach of these terms, in particular fraud or attempts to circumvent the subscription. Except in urgent cases or where the law requires otherwise, we will give notice beforehand.

12. Personal data

How your data is handled is set out in our Privacy Policy, which forms an integral part of these terms.

13. Changes to these terms

These terms may be amended to reflect changes to the app or to the applicable regulations.

If we make a substantial change, you will be informed in the app before it takes effect. New terms do not apply retroactively to a subscription period already paid for. Continuing to use the app after they take effect constitutes acceptance.

14. Governing law and disputes

These terms are governed by French law.

If something goes wrong, write to us first at contact@espir.io: most situations are resolved that way.

Failing an amicable settlement, you may bring the matter before the competent courts. As a consumer, you retain the right to bring proceedings either where you are domiciled or where we are established. If you reside in the European Union, mandatory consumer protections under your own national law remain available to you.

Please note that subscriptions are sold through Apple and Google: disputes concerning payment or billing should be addressed directly to the relevant store, as set out in section 5.7.
